Introduction and Scope of Services


We make every effort to provide you with the best services in a pleasant, friendly yet professional manner at all times. We strive for your complete satisfaction of an authentic Indian experience to the best of our ability without any misunderstandings between your good-selves and “us” i.e. Holiday In India. We believe in forgiveness, gratitude, positive attitude and innovation and at times even go beyond legal formats to ensure that all the issues of guest/s are resolved in timely and friendly manner. The Terms and Conditions – hereinafter referred to as Terms and Conditions given here-under on our website form the basis of our agreement and understanding with you. Holiday In India and our “Guests” i.e. all persons named on the booking confirmation, require to follow policies, rules & regulations, laws & orders of visiting destinations and of India at large. You are requested to read and understand all the Terms and Conditions and the package details mentioned on our website, before you register yourself / family / friends for our tour as a ‘Guest’ to use our services. By making a booking with us, you agree to the terms and conditions laid down by the organizer, Holiday In India i.e us.

 

1) Short Title, Extent and Commencement
a. These Terms and Conditions shall be called Holiday In India Terms & Conditions
b. Terms and Conditions extend to whole of India and to any tours organized by Holiday In India.
c. Terms and Conditions shall come in force from 1st January 2024 and will remain in force till further modification or amendment

 

  1. Definitions: In these Terms and Conditions unless the context otherwise requires
    Company or Organiser: means ‘Holiday In India’
    Force Majeure: means an event or circumstance not within the reasonable control, directly or indirectly, of Holiday In India, in its ability to perform its obligations / responsibilities regarding the tour including (a) war, hostilities invasion, act of foreign enemies; (b) rebellion, revolution, insurrection or military or usurped power or civil war; (c) epidemic, explosion, fire, flood, earthquake or other exceptional natural calamity and act of God; (d) ionizing radiation or contamination by radioactivity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radioactive toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly; (e) riot, commotion or disorder; (f) any act or omission of any Government instrumentality; (g) a Change in Legal Requirements; (h) strikes, lock outs or other industrial disturbances; and (i) abnormal weather or sea conditions including tempest, lightning, hurricane, typhoon, rain and temperatures. (j) unforeseen cancellation by contractors like hotel, transport, suspension of airlines, railways, retreat organisers, bus services etc.
    Group Tours: mean such tours which are carried out in groups containing various individuals, families and where the services provided are similar to all the guest/s in that group.
    Guest(s): means the person in whose name or on whose behalf booking and/or registration is made for any of the tour packages organized by Holiday In India.
    Independent Contractor: means a person and / or organization selected by Holiday In India to render services including transport, wellness retreat, hotel/ accommodation, restaurant, sightseeing to the guest/s and / or to Holiday In India. Independent Contractor is not an employee, partner or joint venture of Holiday In India.
    Meal: means breakfast, lunch and dinner and / or any other item clearly mentioned in the package details.
    Tour/s: means any Indian tours – also referred to as ‘package’ or ‘program’ or ‘trip’ or ‘experience’ on the website, carried out within the state of India organized by Holiday In India.
    Working days: These are the days between and including Monday through Friday, and do not include public holidays and weekends.
  2. General Explanations
    Each provision/term of these Terms and Conditions shall be severable and if any provision thereof is declared invalid, illegal or unenforceable, then remaining provisions nevertheless shall have full force and effect.
    The masculine gender, shall also include feminine gender and vice versa, the singular shall also include plural and vice versa and shall include grammatical variations thereof.

 

2) Scope of Activity
Holiday In India is an organization that coordinates all the services of the tour to help the guest/s for undertaking the tour. Holiday In India takes utmost care in selecting all the services and/or Independent Contractors who provide their services, to make our guest/s comfortable on tour. Holiday In India selects various aspects of the tour such as retreat organizer, wellness package, hotel, type of room, restaurant, transport etc. and does not have any control over operating of the same. Though Holiday In India takes utmost care of our guest/s; Holiday In India shall not be held responsible for any loss, harm, injury, death, damage caused by default, omission or act of employees or management of any such agencies or Independent Contractors. All the guest/s booking and / or registering for tour organized / proposed to be organized by Holiday In India shall read, understand and abide by and strictly comply and observe all the terms and conditions laid down herein or in any / all other publications by Holiday In India. We endeavour to update our guest/s from time to time by sending the guest/s various tour related instructions through emails / telephone/ or by any other mode of communication, solely for convenience of the guest/s. Guest/s should check e-mails regularly for updates sent from Holiday In India, email id – info@holidayinindia.in . However, guest/s are advised to visit website www.holidayinindia.in to keep yourself updated with the Terms and Conditions, as Holiday In India reserves the rights to change the Terms and Conditions at any time.

 

3) Website/ Mobile App/ Social Media Posts & Ads
All previous package details including tariff/ price communicated via website, e-mail, telephone or any other modes of circulation printed and / or published by Holiday In India shall stand cancelled on publication of latest package details and tariff/ price via website / Mobile App / social media post & ad, e-mail / telephone etc.. Every effort is made to ensure accuracy in publication, based on the available information at the time of publication of the package details. The daily schedule or program details used therein and any other modes of circulation printed and/or published by Holiday In India are inserted solely for convenience of guest/s and are not necessarily to scale and / or final.

 

If the daily schedule, tour conditions and the situations then requires Holiday In India to change any information, without assigning any reasons, Holiday In India reserves the right to change any package information including tour itinerary, tour tariff, date of program, number of nights at the destination and hotels before or after any guest makes booking and / or registration for any tour and / or after the departure of any tour.

 

4) Booking
a. Tour booking
A booking made with Holiday In India with 100% advance payment shall mean acceptance by the guest/s in totality of the Terms and Conditions contained herein. Affixing name/s of one or more guest/s if the group includes large number of guest/s on the ‘Booking Confirmation’ e-mail from Holiday In India, shall be deemed to mean that the guest/s other than the one corresponding with Holiday In India have duly authorized the corresponding guest/s and all the guest/s for whom the Booking was made and shall be deemed to have been bound by the terms and conditions contained herein.

 

b. Online Booking
Guest/s can book tour / package online by paying 100% amount in advance as per the price mentioned in the respective package on our website www.holidayinindia.in using the payment details mentioned in the e-mail sent to the guest/s by Holiday In India. Booking will be confirmed only once 100% advance payment is received in the organiser’s bank account and will be processed depending on seat/s availability for the respective package/ program. Online booking is handled from our office situated at Thane. Any dispute or grievances incurred due to online booking shall have exclusive jurisdiction of Thane Court only. We have secured our website with protection technologies to ensure that your information will be kept secure and confidential. However, Holiday In India will not be responsible with respect to online booking due to any reason which is not controllable such as booking engine’s malfunction including software or network errors. Your online booking confirms your acceptance of terms and conditions mentioned on our website www.holidayinindia.in . Guest/s needs to go through our terms and conditions and privacy policy, which are displayed on our website. Guest/s needs to send a copy of the first two pages and last two pages of their passport which clearly shows all personal details that are required for making all bookings such as the name, date of birth, place of passport issue, date of passport issue and expiry, address etc. Service charges, if any, applicable for online payment is payable by Guest.

 

c. Guest(s)’ intention to participate in the tour
The payment of 100% booking amount as specified in the respective package indicates guest/s’ intention of participation in the tour.

 

  1. Guest/s in need of special assistance
    Holiday In India, without committing itself or being held responsible in any way whatsoever, shall make reasonable attempt to accommodate the special needs of disabled guests / senior citizens if informed with required documentations at the time of booking subject to availability & with cost attached to it. However, guest must bear in mind that the possibility of availability of these services totally depends on the Independent Contractors who, at times, may not be equipped with the requirements. Most transportation services are not equipped with wheel chair ramps. A qualified companion at the entire cost of the disabled guest/senior citizen must accompany the guest who may need such services / assistance as the same are not provided by Holiday In India.
  2. Minimum booking of the tour
    In case of group tour/s, the tour shall proceed only if the minimum required number of guest/s have booked the tour and the said booking of the minimum required number of guest/s must be received by Holiday In India within the required time period prior to the scheduled start of the tour. The minimum required number of guest/s shall be decided by Holiday In India and will be clearly displayed on the website or communicated in the e-mail. If the number of guest/s booked for any tour falls below the minimum required number of guest/s, then the tour may be either postponed to be merged with any other tour at a later date and / or cancelled due to insufficient number of bookings. In such an event of cancellation, the guest/s can claim only the amount paid by them after deducting the taxes applicable on the respective package. Till the total number of guest/s reaches the minimum required number of guest/s, the booking of the guest/s shall be strictly provisional. In the event of Holiday In India deciding to cancel the tour, cancellation of tour shall be communicated at least 15 calendar days prior to the date of commencement of tour via e-mail as per the information given by the guest/s or by any person for and on behalf of guest/s at the time of booking of the tour.

d. Health
Guest/s hereby acknowledge that all the guest/s who have booked the tour have gone through the itinerary and are well-aware about the same and are medically fit to undertake the said tour. The Company reserves the right to ask the guest/s to provide written certification of their medical fitness before departure. The persons who are medically fit to undertake the said tours only shall join the said tour. The persons who are and / or who have suffered from any ailments for which they have taken medical treatment and/or have gone into check-up and/or hospitalization shall join the tour at their own risk. In case of any health emergency or health-related issues while touring, the guest/s shall solely be responsible for it and to make their own arrangements on the tour for medical assistance & other expenses. Guest/s shall not expect Holiday In India to provide any medical assistance or treatment. It is possible that the tour may need to be restricted / modified / amended due to this reason/s. No refund is applicable in such case.

 

e. Death
In case of death of guest/s, all the arrangements for transportation of dead body including procuring the death certificate, postmortem, repatriation of dead body and all personal effects/property and insurance claims etc. shall be made by the deceased member’s family or friends, whether accompanying them on the tour or not. Company shall make all endeavour in good faith to extend any help but cannot guarantee the same. The entire expenses shall be borne by the family or friends of the deceased, whether accompanying them on the tour or not. Holiday In India shall not be responsible for the same. If family or friends of the deceased want to visit the country where the guest/s has passed away, all the necessary arrangement shall be made and borne by the said family and/ or friends on their own.

 

f. Persons other than those booked
Persons, friends or relatives of the guest/s, who have not booked the tour with Holiday In India, shall not be allowed in wellness centers, hotel rooms, restaurants, coaches and sight-seeing places or for any activity on the tour.

 

5) Insurance
The tour cost does not include insurance charges of any sort. Guest/s are advised and recommended to acquire adequate Overseas Travel Insurance cover as per requirement of the government of the destination country concerning meeting of expenses including medical, legal hospitalization, accident etc. during the tour. This is the sole responsibility of the guest/s. In case of any unfortunate event while on tour like hospitalization and / or unfortunate demise, it shall be the sole responsibility of the guest/s and / or family or friends of the hospitalized person/deceased to contact and submit the necessary claim to insurance authorities for further processing of the claim.

 

6) Payments by Guest
a. Payment
The 100% booking amount paid in advance at the time of the booking, is not refundable and is interest free. The bookings shall be processed by Holiday In India only after the booking amount is paid in full and received in the their bank account in advance. In case of billing errors, Company reserves the right to re-invoice. Holiday In India reserves the right to take necessary legal action in respect of dishonoured payments via bank transactions or any other mode of payments, as may be advised.

 

b. Travel Loans
Company welcomes the loan facilities granted by the banks to the eligible guest/s for any of the tours, if it fulfils the payment conditions of the tour laid down by Holiday In India. Holiday In India is; however, not responsible / liable for grant / rejection / refund / repayment etc. of such loans availed of by the guest/s, if any.

 

c. Tour Tariff
The tariff or price of the tour quotation is calculated as per the rates prevailing at the time of quoting it. Holiday In India reserves the right to change the tariff in the event of modification / alteration / change / variation in the said rates before the date of departure. Any such increase in the tour tariff accordingly, must be paid in full by the guest/s before tour departure. Any increase in tour tariff during the tour must be paid in full by the guest/s on tour. Tours start with the first scheduled travel as mentioned in the package details or itinerary. Guest/s hereby unconditionally accept that the prices, set of services and inclusions may vary based on package to package or destination to destination and the same shall not be considered for any kind of comparison universally. Tour tariff mentioned on our website / Mobile App/ social media at the time of publication are subject to change.

 

d. Direct payment to bank account
Guest/s should inform Holiday In India for any payment/s made by them to Holiday In India’s bank account through bank transfers or payment gateway, within 24 hours with valid proof of payment by e-mail. Payment receipt and Booking Confirmation will be issued only after Holiday In India receives the funds in their bank account.

 

7) Documents
a. Loss of Passport or other documents
Guest/s are responsible for taking care of their documents and belongings on the travels. Loss of passport on tour involves costs and consequences such as filing FIR, visiting the Embassy, getting new passport or landing certificate, expenses on the stay, food, transportation etc. all of which have to be borne and paid by the concerned guest/s only. Getting the landing certificate or the new passport is the sole responsibility of guest/s. Holiday In India is not responsible or liable or under obligation, for the loss of passport and/or any consequences thereof. Entire consequential expenses shall be borne by the guest/s. Any other guest/s accompanying the guest who has lost the passport, wishing to terminate the tour mid-way, shall also be responsible to meet the related / consequential expenses etc. No refund shall be given for the guest/s leaving the tour mid-way.

 

8) Accommodation
Holiday In India takes care to choose comfortable accommodation and book the same on behalf of guest/s as specified in respective package details, subject to availability. Please read the package details carefully to fully understand the type of accommodation that comes with respective packages. Most of the rooms have an attached toilet, bathroom/ shower; depending on the type of accommodation. Air-conditioning, central heating and other facilities are provided by the hotels depending upon various factors including weather / climatic conditions, local systems, tour type, etc. In case of any improvements required in the hotel services, guest/s are requested to inform the hotel reception directly. Hotel’s management / administration shall be solely responsible for all the service-related issues of the hotel staff.


All baggage and personal belongings under all circumstances is the sole responsibility of guest/s. Any damages to the hotel room or accommodation, visiting place during the stay / visit / tour and the charges thereof, shall be the sole responsibility of guest/s.
Guest/s availing additional facilities, over and above the ones included in the package provided by Holiday In India, such as laundry, telephone, mini bar, alcohol, beverages, food, optional excursions, excess baggage fees, shopping, paid toilet, paid television channels etc. have to be paid by the guest/s before leaving the accommodation/ hotel/ ship / cruise or restaurant etc. as the case may be.


Holiday In India reserves the right to change the accommodation or room types or location of accommodation at any time. Guest/s are required to abide by Hotel Policies at all times; including the check-in and check-out timings of the respective hotels/ accommodation.

 

9) Meals
The types of meals and number of meals included vary depending on the chosen tour or package. Please read the package details carefully for the respective package that you wish to book. These are available on the respective pages for each tour or package on our website. Some places offer a pre-set menu for meals depending on the tour program. Some programs serve only vegetarian meals; while with some others there is a possibility of a non-vegetarian meal. In case of a special dietary requirement, please inform the restaurant beforehand. This is the sole responsibility of the guest/s. No Complaints / Claims for refund in respect of the meals at any location shall be entertained by Holiday In India.

 

10) Baggage
Guest/s are responsible for taking care of their own baggage at all times. In case the guest/s decides to avail any porter services at any location, the charges or tips for these services rendered to carry guest/s baggage is solely the responsibility of the guest/s and have to be paid directly to the service provider.

 

11) Cancellation / Rescheduling of tour booking / Refund Policy
a. Cancellation by guest/s
Holiday In India requires to book services like wellness programs, accommodation, local transportation etc. all well in advance, in order to be able to provide a smooth, convenient and comfortable holiday experience for all of our guest/s. In order to confirm these reservations, we need to make all the necessary payments in advance. In such a situation, if the guest/s do not avail the services, then Holiday In India has to bare the complete expenses and incur huge losses.

 

In order to protect the business from heavy anticipated losses, Holiday In India follows a strict no cancellation, no rescheduling and no refund policy. Guest/s need to make a 100% advance payment to confirm their booking for a tour of their choice. A confirmed booking confirms the guest/s’ acceptance of our terms and conditions mentioned on our website. Once the full payment is made and received in the bank account, Holiday In India confirms the booking via a confirmation e-mail. Once a booking is confirmed, it cannot be cancelled or rescheduled to a later date or passed on to other individual/s for whatsoever reasons. No refund will be provided for any confirmed bookings.

 

b. Cancellation by Holiday In India
Holiday In India may cancel/reschedule the tour due to insufficient number of guests on a tour or due to change in the tour program or without assigning any reason. In such an event the guest/s can claim the amount paid by them after deducting the taxes.


When Holiday In India decides to cancel the tour, cancellation of tour shall be communicated at least 15 calendar days prior to the date of commencement of tour; unless Force Majuere situation applies, via e-mail, provided by the guest/s at the time of booking with Holiday In India.

 

c. Cancellation due to Force Majeure Situations
1. Under Force Majuere situation, Holiday In India reserves the right to cancel, partly cancel, modify the original tour plan and/or reschedule the tour considering safety of the Guest/s.
2. No refund, whether fully or partly is applicable on cancellation under any circumstances due to Force Majeure
3. Holiday In India will request suppliers/ independent contractor for assisting in postponement of tour/s and guest/s can join the next possible date of same tour. In such a situation, Guest/s are required to pay additional costs, if applicable.

 

d. No show – Deemed cancellation
If the guest/s fail to join or attend the program as scheduled in the tour plan, it will be termed as a No Show – deemed cancellation and no refund will be provided by Holiday In India in this situation. In this case, all the services listed as part of the package will stand cancelled with no refund.

 

e. Refund
Refund, if any, for whatsoever reasons, of any tour organized by Holiday In India shall be paid directly to the guest/s by bank transfer, in the same bank account of the guest and using the same currency, that was used at the time of booking.

 

12) Privacy Policy
Any personal information/ data furnished by the guest/s to Holiday In India at the time of booking, is subject to disclosure thereof as required by law or by an order of court or the rules, regulations and inquiry by any government / statutory authority. Holiday In India does not indulge in selling of any personal data of guest/s’ for whatsoever reasons.

 

13) Photographs or Video Clips
Holiday In India reserves the right to use Photographs / Video Clips of the guest/s; including direct guest/s of the independent contractors/ suppliers, taken on tour and / or given by guest, for promotion of Holiday In India’s business without obtaining prior permission of the concerned guest/s. Such Photographs / Video Clips can be used on our website, mobile app, social media posts & ads or any other platform with due respect for emotions/sentiments of the guest/s.

 

14) Jurisdiction
All disputes pertaining to the packages listed by Holiday In India on our website www.holidayinindia.in and any claim/s arising thereunder shall be subject to the Court of competent jurisdiction at Thane only.
